Independent Contractor Process and Policy


An Independent Contractor (IC) must be pre-authorized through Human Resources prior to engagement.  The University is required to qualify and prove the status of an IC based on the scope of the work and the individual’s ability to successfully meet the stringent criteria required by the IRS, DOL and State mandated qualifying tests.  The primary criteria resides in the control of the work, type and level of the work, and the knowledge basis (expertise), experience, and background of the individual candidate.  Individuals who qualify will be required to successfully complete a standard background check and will be contracted as an IC through the appropriate Liberty University Independent Contractor form, following the regular Contract Administration/Buy LU process.

Typically, current employees and employees who have been terminated for less than one year will not meet the required criteria to qualify as an IC.  Individuals who seek to provide services as an IC will typically need to prove their qualification for this status by showing the ability to control the work with limited supervision, along with providing proof of performing similar high-level services for other clients.

Management anticipates a limited number of individuals seeking the status of IC will qualify, and that the department or school will need to hire the individual as an employee under the applicable status of regular full-time, part-time, or temporary part-time.

The required Independent Contractor Questionnaire must be approved by HR prior to engagement of the perspective IC. HR will review each prospective IC to ensure qualifications and compliance.


Before submitting an Independent Contractor Contract through buyLU the Independent Contractor Qualification Questionnaire must be submitted to and approved by Human Resources.

  1. Fill out and complete the IC questionnaire (link). You will receive the signed IC questionnaire back within 2-3 business days.
  2. If the IC questionnaire is approved, and a background check is required, your prospective independent contractor will receive a link from First Advantage to be completed. 
  3. Submit your IC contract with the attached final IC questionnaire and supplemental documentation through buyLU for Contract Administration’s review.
  4. Proceed through the normal contract and procurement process.
