The Federalist Society at Liberty University School of Law recently hosted a panel discussion, “The Property Rights You Never Knew You Had: Examining the Current State of Property Rights in the United States,” this past Friday, February 18.
The panel consisted of the following speakers:
· Professor Steven Eagle, Professor of Law at George Mason University School of Law, discussed the “Development of Property Rights in America and the Property Rights Movement”
· Professor John Kunich, Fulbright Senior Specialist and Professor of Law at Indian Law Institute, New Delhi, discussed the “Development of Property Rights to Protect the Environment”
“Prof. Kunich and Prof. Eagle gave insightful commentary on important constitutional property issues, such as why regulatory taking through environmental restrictions ignores the constitutional requirement of just compensation. Thus, when the near extinct juju-beetle is found in your backyard, your property is taken to preserve the species without just compensation,” according to Paul Brodersen, President of the Federalist Society Liberty Chapter. “This is an interesting, and scary, progression of property law in the overly intrusive administrative state that America has become.”
The Federalist Society at Liberty University School of Law consists of conservative law students interested in the current state of judiciary and legal affairs. The Society was founded on the principles that the state exists to preserve freedom, that the separation of governmental powers is central to our Constitution, and that it is emphatically the province and duty of the judiciary to say what the law is, not what it should be.
