No Contact Directives

 

A No Contact Directive (NCD) issued by the Office of Equity and Compliance/Title IX prohibits two people from contacting one another through any means.

 

More Information

  • The OEC will issue a NCD between parties at the start of the OEC complaint resolution process or as a supportive measure.
  • Typically, after the NCD is issued, it will remain in place until further notice. 
  • The NCD is mutual, meaning it prohibits both parties from contacting one another through any means, which includes verbal and nonverbal contact.

 

Where Does the NCD Apply?

The NCD applies:

  • On-campus
  • At University-sponsored events
  • Off-campus
  • Electronically while the parties remain Liberty students or employees.

 

Both parties must make all reasonable efforts to remain at least 25 feet from each other at all times (about a bus length apart). Special arrangements will be initiated when these restrictions are detrimental to the student’s academic pursuits, such as the limited availability of courses and classrooms (i.e., LUCOM, LUSOL).

 

What the NCD is NOT.

  • The NCD is not indicating responsibility for violating The Sexual Misconduct Policy or Nondiscrimination and Equal Opportunity Policy; rather, it is intended to cease contact between the parties to restore and preserve access to the parties’ education.
  • The NCD does not become a part of the parties’ permanent University record. However, a violation of a NCD may result in disciplinary action. If either Party reports a violation of the NCD, an investigation will be conducted to determine whether it is more than likely than not (the preponderance of the evidence standard) that the NCD was violated. Both Parties may be allowed to provide relevant information before a determination is made. If a violation is determined, appropriate academic sanctions may be imposed based on the nature of the violation.

 

Be Advised.

LUPD is informed of all NCDs and assists the OEC in the enforcement of all NCDs. An NCD is different and separate from a court or magistrate-issued Virginia civil protective order.
